HON’BLE SUPREME COURT JUDGEMENT DATED 15.02.2018

Dear Comrades,

Please find attached CBPRO letter to IBA consequent to the Hon’ble Supreme Court judgement making it clear that imposing any of the penalties specified under Regulation 4 of Officer (Employees) Discipline Appeal Regulations after the date of superannuation is impermissible and hence illegal.

In view of the Supreme Court’s judgement relying on its earlier ones that  held that an officer even if issued charge sheet before retirement, can be given penalty under Pension Regulations and not under D & A Regulations, it is suggested by our General Secretary that all those given reduction in grade and pay after retirement may represent to the bank that penalty given under D & A Regulations is illegal and has to be withdrawn.
